PART I – PRELIMINARY PROVISIONS

1. Introduction

Welcome to ConsulTOpen.

This User Code of Conduct ("Code") establishes the standards of behaviour, responsibilities, expectations and rules governing every User accessing or using the ConsulTOpen Platform.

The purpose of this Code is to promote a safe, respectful, inclusive and professional environment that enables meaningful consultations, protects every participant and supports the integrity of the ConsulTOpen community.

This Code applies to every interaction occurring on or through the Platform, including interactions involving:

  • consultation bookings;
  • consultations;
  • Platform communications;
  • reviews and ratings;
  • profile creation;
  • Artificial Intelligence features;
  • payments;
  • community participation;
  • customer support;
  • future Platform features; and
  • every other service provided by ConsulTOpen.

Without limitation, this Code applies to:

  • students;
  • parents;
  • legal guardians;
  • working professionals;
  • corporate users;
  • educational institutions;
  • enterprise users;
  • guest users;
  • beta participants; and
  • every future category of User introduced by ConsulTOpen.

Users are expected to:

  • behave respectfully;
  • communicate honestly;
  • act responsibly;
  • comply with applicable laws;
  • follow Platform Policies;
  • respect Consultants;
  • respect other Users;
  • protect confidential information;
  • use Platform features responsibly; and
  • contribute positively to the ConsulTOpen community.

ConsulTOpen maintains zero tolerance for conduct that compromises User safety, Platform integrity or the quality of services provided through the Platform.

Nothing contained in this Code creates an employer-employee, partnership, agency or fiduciary relationship between ConsulTOpen and any User.

This Code forms an integral part of the contractual and operational framework governing use of the ConsulTOpen Platform.

2. Purpose

The purpose of this Code is to establish clear behavioural expectations for every User of the ConsulTOpen Platform.

Without limitation, this Code governs:

  • respectful conduct;
  • responsible Platform usage;
  • consultation behaviour;
  • communication standards;
  • privacy obligations;
  • confidentiality obligations;
  • Child Safety requirements;
  • Parent Consent requirements;
  • Artificial Intelligence usage;
  • prohibited conduct;
  • fraud prevention;
  • payment-related conduct;
  • review and rating behaviour;
  • community participation;
  • reporting procedures;
  • investigations;
  • disciplinary measures;
  • Platform enforcement; and
  • every other matter reasonably connected with User conduct.

This Code is intended to:

  • promote respectful interactions;
  • protect Consultants;
  • protect Users;
  • maintain Platform integrity;
  • encourage honest participation;
  • support meaningful consultations;
  • reduce misuse of Platform services;
  • maintain community trust;
  • support legal compliance; and
  • create a safe learning and counselling environment.

3. Scope

This Code applies to every User who accesses, browses, registers for, books services through or otherwise uses the ConsulTOpen Platform.

Without limitation, this Code applies irrespective of:

  • User category;
  • subscription plan;
  • consultation category;
  • consultation format;
  • payment method;
  • geographical location;
  • language used;
  • operating system;
  • device used;
  • communication method; or
  • future Platform technologies introduced by ConsulTOpen.

This Code applies before, during and after every consultation where the relevant conduct relates to the use of the Platform.

This Code shall continue to apply to any conduct connected with the Platform even where a consultation has concluded.

4. Definitions

For the purposes of this Code:

"User" means any individual or entity accessing, browsing, registering for or using the ConsulTOpen Platform.

"Consultant" means an individual approved by ConsulTOpen to provide professional services through the Platform.

"Platform" means the ConsulTOpen website, mobile applications, software, Artificial Intelligence systems and every related service operated by ConsulTOpen.

"Consultation" means any professional interaction between a User and a Consultant conducted through or facilitated by the Platform.

"Minor User" means a User who has not attained the age of majority under applicable law.

"Artificial Intelligence" or "AI" means any automated technology, machine learning system or intelligent software feature made available through the Platform.

"Community" means every User, Consultant and participant interacting through the Platform.

Unless otherwise defined herein, capitalised terms shall have the meanings assigned to them in the Terms & Conditions or other applicable Platform Policies.

5. Applicability

Compliance with this Code is mandatory for every User accessing or using the ConsulTOpen Platform.

This Code applies from the moment a User first accesses the Platform and continues throughout the User's use of Platform services.

Where applicable, Parents or Legal Guardians shall also comply with this Code when acting on behalf of Minor Users.

Failure to comply with this Code may result in:

  • warnings;
  • removal of content;
  • cancellation of consultations;
  • suspension of Platform features;
  • suspension of User Accounts;
  • permanent termination of User Accounts;
  • reporting to relevant authorities where required by law; or
  • any other lawful action considered reasonably necessary by ConsulTOpen.

6. Relationship with Other Policies

This User Code of Conduct forms an integral part of the legal and operational framework governing the ConsulTOpen Platform.

This Code shall be read together with:

  • Terms & Conditions;
  • Privacy Policy;
  • Cookie & Data Retention Policy;
  • Session Standards Policy;
  • Refund Policy;
  • Payout & Commission Policy;
  • Consultant Terms & Conditions;
  • Consultant Code of Conduct;
  • Consultant Onboarding Handbook;
  • AI Usage Disclaimer;
  • Recommendation Disclaimer;
  • Career Guidance Disclaimer;
  • Mental Wellness Disclaimer;
  • Intellectual Property Policy;
  • Community Guidelines;
  • Child Safety Policy;
  • Parent Consent Policy;
  • Grievance Redressal Policy; and
  • every future Platform Policy published by ConsulTOpen.

Where any inconsistency exists between this Code and another Platform Policy, the more specific provision governing User conduct shall prevail with respect to the relevant subject matter unless otherwise required by applicable law.

7. Acceptance

This User Code of Conduct constitutes an electronic record governing User conduct on the ConsulTOpen Platform.

A User shall be deemed to have accepted this Code by:

  • accessing the Platform;
  • creating a User Account;
  • browsing the Platform;
  • booking consultations;
  • participating in consultations;
  • communicating through the Platform;
  • using Artificial Intelligence features;
  • making payments;
  • purchasing subscriptions;
  • continuing to use the Platform after publication of this Code; or
  • otherwise using any Platform service.

Electronic acceptance of this Code shall have the same legal validity and enforceability as a handwritten signature to the fullest extent permitted under applicable law.

By accepting this Code, every User acknowledges that they have read, understood and agree to comply with the behavioural standards, responsibilities and obligations established herein together with every other applicable Platform Policy.

PART II – GENERAL STANDARDS OF CONDUCT

8. Respect for Others

Every User shall treat Consultants, other Users, ConsulTOpen personnel and every individual interacting through the Platform with dignity, courtesy and respect.

Without limitation, Users shall:

  • communicate respectfully;
  • demonstrate courtesy;
  • respect differing opinions;
  • avoid personal attacks;
  • exercise patience;
  • behave professionally during consultations;
  • avoid intimidation;
  • respect personal boundaries;
  • cooperate in good faith; and
  • contribute to a positive Platform environment.

Users shall not engage in conduct that may reasonably be considered offensive, degrading, intimidating or harmful to another person.

Respect for others remains mandatory throughout every interaction conducted through or relating to the Platform.

9. Honest Participation

Users shall participate honestly in every aspect of their use of the ConsulTOpen Platform.

Without limitation, Users shall:

  • provide truthful information;
  • communicate honestly;
  • participate in consultations in good faith;
  • make genuine consultation bookings;
  • use Platform services only for legitimate purposes;
  • accurately describe their circumstances where relevant;
  • cooperate honestly during investigations;
  • provide truthful feedback;
  • avoid misleading statements; and
  • comply with applicable Platform Policies.

Users shall not intentionally deceive Consultants, ConsulTOpen or other Users.

Honest participation is essential to maintaining trust throughout the Platform.

10. Accurate Information

Users shall ensure that every material piece of information provided through the Platform is accurate, complete and up to date.

Without limitation, Users shall provide accurate:

  • name;
  • age;
  • contact information;
  • educational information;
  • career information;
  • payment information;
  • consultation requirements;
  • identity verification information;
  • parental consent information where applicable; and
  • every other material detail reasonably required for Platform services.

Users shall promptly update inaccurate or outdated information.

Providing false, misleading or fraudulent information may result in corrective action under this Code.

11. Responsible Platform Usage

Users shall use the Platform responsibly, ethically and in accordance with applicable law.

Without limitation, Users shall:

  • use Platform services only for lawful purposes;
  • comply with Platform instructions;
  • protect their account credentials;
  • maintain account security;
  • use authorised Platform features;
  • respect Platform limitations;
  • avoid misuse of Platform resources;
  • report security concerns where appropriate;
  • comply with subscription requirements; and
  • cooperate with reasonable operational procedures.

Users remain responsible for every activity occurring through their User Account unless otherwise required by applicable law.

12. Digital Citizenship

ConsulTOpen encourages responsible digital citizenship throughout its community.

Accordingly, Users shall:

  • behave respectfully online;
  • communicate responsibly;
  • protect personal information;
  • respect digital privacy;
  • avoid spreading misinformation;
  • verify important information where appropriate;
  • think before posting or communicating;
  • respect cultural diversity;
  • promote constructive dialogue; and
  • contribute positively to the online learning and counselling environment.

Responsible digital citizenship extends to every interaction occurring through the Platform.

13. Respect for Diversity

ConsulTOpen welcomes Users from diverse educational, cultural, linguistic, religious and professional backgrounds.

Users shall respect every individual's:

  • dignity;
  • identity;
  • beliefs;
  • background;
  • culture;
  • language;
  • gender;
  • disability;
  • profession; and
  • personal circumstances.

Users shall not engage in conduct that discriminates against, excludes or unfairly targets another person.

Respect for diversity is fundamental to maintaining an inclusive Platform community.

14. Good Faith Conduct

Users shall act honestly, reasonably and in good faith when using the Platform.

Without limitation, Users shall not:

  • abuse Platform services;
  • misuse consultation bookings;
  • intentionally waste Consultant time;
  • repeatedly book consultations without genuine intention to participate;
  • abuse refund processes;
  • manipulate Platform systems;
  • exploit operational procedures;
  • make malicious complaints;
  • submit knowingly false allegations; or
  • otherwise use the Platform for improper purposes.

Users are expected to exercise reasonable judgment and cooperate with Consultants and ConsulTOpen in a manner that promotes fairness, professionalism and mutual trust.

ConsulTOpen reserves the right to take appropriate action where a User's conduct is inconsistent with the principles of good faith established under this Code.

PART III – SESSION BEHAVIOUR

15. Professional Conduct During Sessions

Every User shall conduct themselves professionally, respectfully and responsibly during every consultation conducted through the ConsulTOpen Platform.

Without limitation, Users shall:

  • participate in good faith;
  • communicate respectfully;
  • remain attentive;
  • cooperate with the Consultant;
  • avoid unnecessary interruptions;
  • follow reasonable consultation procedures;
  • respect professional boundaries;
  • maintain appropriate behaviour throughout the consultation;
  • avoid conduct that disrupts the consultation; and
  • comply with the Session Standards Policy.

Users shall recognise that every consultation is intended to provide a safe, productive and professional environment for meaningful discussion.

16. Respect for Consultants

Users shall treat every Consultant with dignity, courtesy and professional respect.

Without limitation, Users shall not:

  • insult Consultants;
  • threaten Consultants;
  • harass Consultants;
  • intimidate Consultants;
  • use abusive language;
  • repeatedly interrupt Consultants without reasonable cause;
  • pressure Consultants to violate Platform Policies;
  • demand services outside the Consultant's expertise;
  • demand guaranteed outcomes;
  • attempt to manipulate professional opinions; or
  • otherwise engage in conduct inconsistent with respectful professional interactions.

Users acknowledge that Consultants are independent professionals exercising their own professional judgment.

Disagreement with professional advice does not justify abusive or disrespectful behaviour.

17. Respect for Other Users

Where Users interact with one another through the Platform, they shall maintain respectful and appropriate conduct.

Without limitation, Users shall:

  • communicate respectfully;
  • avoid harassment;
  • avoid discrimination;
  • respect differing opinions;
  • avoid bullying;
  • avoid spreading rumours;
  • avoid intimidation;
  • respect personal boundaries;
  • avoid sharing another User's confidential information; and
  • contribute positively to the Platform community.

Users shall not intentionally interfere with another User's ability to access or benefit from Platform services.

18. Punctuality

Users are expected to attend consultations at the scheduled date and time.

Accordingly, Users should:

  • join consultations promptly;
  • ensure they are prepared before the scheduled commencement;
  • maintain adequate internet connectivity;
  • notify the Consultant where reasonably possible if delayed;
  • remain available for the consultation; and
  • respect scheduled consultation timings.

Users acknowledge that repeated lateness may reduce the effectiveness of consultations and may affect their entitlement to certain remedies under applicable Platform Policies.

Nothing contained herein modifies the Session Standards Policy governing consultation timing, No-Show procedures or rescheduling.

19. Appropriate Communication

Users shall communicate respectfully, honestly and professionally throughout every interaction conducted through the Platform.

Without limitation, Users shall not:

  • use abusive language;
  • threaten any participant;
  • engage in harassment;
  • engage in hate speech;
  • make discriminatory remarks;
  • make sexually explicit comments;
  • deliberately provoke conflict;
  • repeatedly interrupt consultations;
  • intentionally spread misinformation; or
  • otherwise communicate in a manner reasonably considered offensive or inappropriate.

Users are encouraged to communicate clearly, honestly and respectfully so that consultations remain constructive and effective.

20. Appropriate Appearance

Users participating in video consultations shall maintain an appearance appropriate for a professional consultation environment.

Without limitation, Users shall not:

  • appear nude;
  • wear sexually explicit clothing;
  • display obscene material;
  • intentionally expose themselves;
  • engage in sexually explicit conduct;
  • display offensive symbols for the purpose of intimidation or harassment; or
  • otherwise behave in a manner inconsistent with a professional consultation.

Appropriate appearance contributes to maintaining a safe, respectful and comfortable environment for every participant.

21. Appropriate Consultation Environment

Users should participate in consultations from an environment that reasonably supports effective communication and privacy.

Where reasonably possible, Users should:

  • minimise background noise;
  • avoid unnecessary interruptions;
  • maintain adequate lighting for video consultations;
  • use stable internet connectivity;
  • ensure appropriate surroundings;
  • participate from a safe location;
  • maintain privacy where appropriate;
  • avoid disruptive activities during consultations;
  • avoid participation while operating vehicles; and
  • take reasonable steps to protect confidential discussions.

Users acknowledge that the quality of their consultation may be affected by unsuitable consultation environments.

22. Recording Restrictions

Users shall not record any consultation, whether by audio recording, video recording, screen recording or any other recording method, without obtaining the prior informed consent of both the Consultant and the User.

Where recording is permitted:

  • consent shall be obtained before recording begins;
  • every participant shall be informed that recording is taking place;
  • recordings shall comply with applicable law;
  • recordings shall comply with Platform Policies;
  • confidentiality obligations shall continue to apply;
  • recordings shall not be publicly distributed without lawful authority; and
  • consent may be withdrawn where permitted by applicable law.

Unauthorised recording may result in disciplinary action under this Code.

23. Session Interruptions

Users shall avoid conduct that unnecessarily interrupts or disrupts consultations.

Without limitation, Users shall not:

  • repeatedly leave and rejoin consultations without reasonable cause;
  • intentionally disconnect from consultations;
  • deliberately create distractions;
  • engage in unrelated activities that materially interfere with the consultation;
  • permit repeated unnecessary interruptions by third parties;
  • intentionally misuse Platform communication tools; or
  • otherwise interfere with the effective conduct of the consultation.

Where unavoidable interruptions occur, Users should make reasonable efforts to resume the consultation promptly.

24. Respect for Consultation Time

Users acknowledge that consultation time is a valuable professional resource.

Accordingly, Users shall not:

  • intentionally waste consultation time;
  • intentionally prolong discussions unrelated to the booked consultation;
  • repeatedly book consultations without genuine intent to participate;
  • misuse complimentary consultations;
  • abuse cancellation or refund procedures;
  • repeatedly reschedule consultations without reasonable justification;
  • engage in conduct intended solely to delay the consultation; or
  • otherwise misuse Consultant availability.

Users are encouraged to prepare for consultations in advance so that the scheduled session may be used efficiently and productively.

Respect for consultation time benefits Users, Consultants and the overall ConsulTOpen community.

PART IV – SAFETY & RESPONSIBLE USE

25. Child Safety

ConsulTOpen is committed to providing a safe environment for Minor Users.

Every User shall respect the rights, dignity, safety and wellbeing of every Minor User accessing the Platform.

Without limitation, Users shall not:

  • engage in grooming behaviour;
  • exploit Minor Users;
  • harass Minor Users;
  • intimidate Minor Users;
  • request inappropriate personal information from Minor Users;
  • encourage unlawful or dangerous behaviour;
  • expose Minor Users to sexually explicit content;
  • engage in inappropriate communication with Minor Users;
  • circumvent Child Safety measures; or
  • otherwise endanger the safety or wellbeing of a Minor User.

Every User shall comply with the Child Safety Policy and applicable law.

ConsulTOpen maintains zero tolerance for conduct that threatens the safety of Minor Users.

26. Parent Consent

Where required by applicable law or Platform Policy, Minor Users shall access consultation services only after obtaining the required consent from a Parent or Legal Guardian.

Users shall not:

  • provide false parental consent;
  • impersonate a Parent or Legal Guardian;
  • submit forged consent documents;
  • bypass Parent Consent procedures;
  • encourage another User to bypass consent requirements; or
  • otherwise interfere with Parent Consent verification.

Parents and Legal Guardians acting on behalf of Minor Users shall cooperate with reasonable verification procedures implemented by ConsulTOpen.

27. Privacy Protection

Users shall respect the privacy rights of every individual using the Platform.

Without limitation, Users shall not:

  • disclose another person's personal information without lawful authority;
  • collect personal information for unauthorised purposes;
  • misuse contact information obtained through the Platform;
  • publish private conversations;
  • misuse consultation information;
  • access another User's account without authorisation;
  • interfere with another person's privacy settings; or
  • otherwise violate the privacy of another individual.

Users shall also take reasonable steps to protect their own personal information while using the Platform.

28. Confidentiality

Users acknowledge that consultations may involve confidential or sensitive information.

Accordingly, Users shall:

  • respect the confidentiality of Consultants;
  • respect the confidentiality of other Users;
  • avoid unauthorised disclosure of consultation content;
  • avoid sharing confidential documents without permission;
  • protect confidential communications;
  • comply with applicable confidentiality obligations; and
  • comply with the Privacy Policy.

Without lawful authority or appropriate consent, Users shall not publish, distribute or otherwise disclose confidential consultation information obtained through the Platform.

29. Identity Verification

Users shall cooperate with every lawful identity verification procedure implemented by ConsulTOpen.

Identity verification may include:

  • account verification;
  • One-Time Password (OTP) verification;
  • government-issued identification;
  • Parent or Legal Guardian verification;
  • payment verification;
  • profile verification;
  • visual verification where applicable;
  • security verification; and
  • any other lawful verification method adopted by ConsulTOpen.

Failure to complete required verification procedures may result in restrictions on Platform access or services.

30. Identity Misrepresentation

Users shall participate on the Platform only using their own genuine identity.

Without limitation, Users shall not:

  • impersonate another individual;
  • create fake accounts;
  • share User Accounts;
  • permit another person to use their account;
  • misrepresent their age;
  • misrepresent educational qualifications;
  • misrepresent professional qualifications;
  • provide forged identification documents;
  • provide false verification information; or
  • otherwise deceive ConsulTOpen, Consultants or other Users regarding their identity.

Identity misrepresentation may result in immediate suspension or termination of Platform access.

31. Emergency Situations

ConsulTOpen is not an emergency response service.

Users experiencing medical, psychiatric, psychological or other emergencies should immediately contact:

  • local emergency services;
  • the nearest hospital;
  • an appropriate emergency healthcare provider;
  • a trusted family member;
  • a Parent or Legal Guardian where applicable; or
  • another appropriate emergency support service.

Users shall not rely upon the Platform as a substitute for emergency intervention.

Where a Consultant reasonably believes that a User may be facing an emergency, the Consultant may take appropriate action in accordance with applicable Platform Policies and applicable law.

32. Responsible Use of Recommendations

Users acknowledge that recommendations, opinions, guidance and suggestions provided through the Platform are intended to assist informed decision-making.

Users shall understand that:

  • recommendations do not constitute guarantees of success;
  • career outcomes cannot be guaranteed;
  • internship opportunities cannot be guaranteed;
  • employment opportunities cannot be guaranteed;
  • educational admissions cannot be guaranteed;
  • scholarship awards cannot be guaranteed;
  • personal outcomes may differ based upon individual circumstances;
  • professional judgment may reasonably differ between Consultants; and
  • final decisions remain the responsibility of the User.

Users shall not misrepresent Consultant recommendations or hold Consultants responsible solely because expected outcomes were not achieved.

33. Responsible AI Usage

ConsulTOpen may provide Artificial Intelligence ("AI") features to assist Users.

Users shall use AI features responsibly, ethically and in accordance with applicable Platform Policies.

Without limitation, Users shall not:

  • intentionally manipulate AI systems;
  • engage in prompt injection attacks;
  • attempt to bypass AI safeguards;
  • use AI to generate unlawful content;
  • use AI to harass another individual;
  • use AI to facilitate academic dishonesty;
  • use AI for fraudulent purposes;
  • overload AI systems through spam or automated abuse;
  • interfere with Platform operations using AI; or
  • otherwise misuse Artificial Intelligence features.

Users acknowledge that AI-generated outputs:

  • may contain errors;
  • may be incomplete;
  • may not reflect current information;
  • do not replace professional advice;
  • should be independently evaluated where appropriate; and
  • remain subject to the applicable AI Usage Disclaimer.

Responsible use of Artificial Intelligence helps maintain a safe, reliable and trustworthy Platform for every User.

PART V – PROHIBITED CONDUCT

34. Harassment

ConsulTOpen maintains zero tolerance for harassment of any kind.

Users shall not harass Consultants, Users, ConsulTOpen personnel or any other individual associated with the Platform.

Harassment includes, without limitation:

  • abusive language;
  • repeated unwanted communication;
  • intimidation;
  • bullying;
  • threats;
  • stalking;
  • offensive remarks;
  • humiliating behaviour;
  • persistent unwanted requests;
  • malicious targeting;
  • online harassment; or
  • any other conduct reasonably considered harassing.

Harassment may result in immediate disciplinary action under this Code.

35. Discrimination

Users shall not discriminate against any individual on the basis of:

  • race;
  • colour;
  • nationality;
  • ethnic origin;
  • religion;
  • disability;
  • age;
  • sex;
  • gender;
  • language;
  • educational background;
  • profession; or
  • any other characteristic protected under applicable law.

Users shall promote an inclusive, respectful and welcoming environment for every participant on the Platform.

Discriminatory conduct may result in immediate suspension or termination of Platform access.

36. Sexual Misconduct

Users shall not engage in any form of sexual misconduct while using the Platform.

Without limitation, Users shall not:

  • make sexually explicit comments;
  • send sexually explicit messages;
  • request sexual favours;
  • expose themselves during video consultations;
  • transmit obscene material;
  • engage in sexually inappropriate conversations;
  • sexually harass Consultants or other Users;
  • make unwanted romantic advances;
  • share pornographic material; or
  • otherwise engage in sexually inappropriate behaviour.

ConsulTOpen maintains zero tolerance for sexual misconduct.

37. Academic Misconduct

ConsulTOpen promotes ethical education and responsible learning.

Users shall not use the Platform to facilitate academic dishonesty.

Without limitation, Users shall not request Consultants or AI systems to:

  • complete assignments on their behalf;
  • complete examinations on their behalf;
  • impersonate them during assessments;
  • prepare fraudulent academic submissions;
  • forge certificates;
  • forge academic documents;
  • manipulate educational records;
  • engage in plagiarism;
  • facilitate cheating; or
  • otherwise violate academic integrity.

Consultants may refuse any request that appears inconsistent with academic honesty.

38. Fraud & Misrepresentation

Users shall not engage in fraudulent, deceptive or dishonest conduct while using the Platform.

Without limitation, Users shall not:

  • provide false information;
  • create fake accounts;
  • impersonate another individual;
  • use stolen payment methods;
  • submit forged documents;
  • falsify consultation information;
  • submit fraudulent refund requests;
  • manipulate Platform systems;
  • misrepresent eligibility for services;
  • engage in identity fraud; or
  • otherwise deceive ConsulTOpen, Consultants or other Users.

Fraudulent conduct may result in immediate suspension, termination and reporting to the appropriate authorities where required by law.

39. Illegal Activities

Users shall not use the Platform for any unlawful purpose.

Without limitation, Users shall not use the Platform to request, promote or facilitate:

  • hacking;
  • cybercrime;
  • fraud;
  • money laundering;
  • terrorist activities;
  • human trafficking;
  • child exploitation;
  • illegal drug activity;
  • violence;
  • unlawful financial activity;
  • document forgery;
  • identity theft;
  • copyright infringement;
  • criminal conspiracy; or
  • any other activity prohibited under applicable law.

ConsulTOpen may immediately report unlawful conduct to the appropriate authorities where required or permitted by law.

40. Platform Misuse

Users shall not misuse, interfere with or compromise the integrity of the Platform.

Without limitation, Users shall not:

  • exploit software vulnerabilities;
  • reverse engineer the Platform;
  • bypass subscription requirements;
  • scrape Platform data;
  • use automated bots without authorisation;
  • interfere with Platform operations;
  • distribute malware;
  • attempt unauthorised access;
  • overload Platform systems;
  • interfere with Platform security;
  • test Platform vulnerabilities without authorisation; or
  • otherwise misuse Platform resources.

Platform misuse may result in immediate suspension together with any other lawful action considered appropriate.

41. Off-platform Solicitation

Users shall not attempt to circumvent the ConsulTOpen Platform by soliciting Consultants to communicate or transact outside authorised Platform channels.

Without limitation, Users shall not:

  • request personal phone numbers;
  • request WhatsApp communication;
  • request Telegram communication;
  • request Instagram communication;
  • request personal email addresses;
  • arrange private consultations outside the Platform;
  • encourage Consultants to bypass Platform bookings;
  • solicit off-platform payments; or
  • otherwise interfere with the commercial integrity of the Platform.

Nothing contained herein prevents communication expressly authorised by ConsulTOpen or required by applicable law.

42. Unauthorised Payments

Users shall not attempt to make payments directly to Consultants for services intended to be provided through the ConsulTOpen Platform.

Without limitation, Users shall not:

  • pay Consultants outside the Platform;
  • request discounted off-platform consultations;
  • encourage Consultants to avoid Platform commissions;
  • request alternative payment methods to bypass Platform payments;
  • split payments outside authorised payment systems; or
  • otherwise interfere with the Platform's authorised payment processes.

Every consultation booked through ConsulTOpen shall be paid for using the authorised Platform payment methods unless expressly approved otherwise by ConsulTOpen.

43. Review Manipulation

Users shall provide honest, fair and genuine reviews based upon their own consultation experience.

Users shall not:

  • submit fake reviews;
  • submit misleading reviews;
  • threaten Consultants with negative reviews to obtain refunds or discounts;
  • offer incentives for positive reviews;
  • manipulate ratings;
  • coordinate fraudulent review campaigns;
  • submit reviews relating to consultations never attended;
  • impersonate another User when reviewing; or
  • otherwise misuse the Platform's review system.

ConsulTOpen reserves the right to remove reviews that violate this Code or other Platform Policies.

44. Weapons, Violence & Dangerous Conduct

Users shall not engage in violent, threatening or dangerous behaviour while using the Platform.

Without limitation, Users shall not:

  • display firearms during consultations;
  • display dangerous weapons;
  • threaten violence;
  • encourage violence;
  • glorify criminal conduct;
  • display illegal drugs;
  • engage in self-harm demonstrations;
  • intimidate another participant using dangerous objects;
  • promote unlawful violence; or
  • otherwise create an unsafe consultation environment.

Where appropriate, ConsulTOpen may immediately suspend the consultation and take any lawful action reasonably necessary to protect participants.

45. Misuse of Intellectual Property

Users shall respect the intellectual property rights of ConsulTOpen, Consultants and third parties.

Without limitation, Users shall not:

  • copy copyrighted Platform content without authorisation;
  • reproduce consultation materials without permission;
  • distribute proprietary resources unlawfully;
  • misuse trademarks;
  • remove copyright notices;
  • upload infringing material;
  • claim ownership of another person's work;
  • misuse Platform branding;
  • violate licence terms; or
  • otherwise infringe intellectual property rights.

Users remain solely responsible for ensuring that content uploaded, shared or distributed through the Platform does not infringe the rights of any third party.

Violations of intellectual property rights may result in removal of content, suspension of Platform access, legal action or any other remedy available under applicable law.

PART VI – COMMUNITY RESPONSIBILITIES

46. Community Behaviour

ConsulTOpen is committed to fostering a safe, respectful, inclusive and supportive community for every User.

Users shall contribute positively to the Platform community.

Without limitation, Users shall:

  • communicate respectfully;
  • support constructive discussions;
  • respect differing viewpoints;
  • encourage ethical learning;
  • avoid spreading misinformation;
  • comply with Community Guidelines;
  • cooperate with Consultants;
  • maintain professional interactions;
  • contribute to a welcoming environment; and
  • uphold the values of the ConsulTOpen community.

Users shall not intentionally create hostility, conflict or disruption within the Platform community.

47. Platform Reputation

Users shall not intentionally damage or undermine the reputation, integrity or goodwill of ConsulTOpen through dishonest or malicious conduct.

Without limitation, Users shall not:

  • submit knowingly false complaints;
  • organise malicious campaigns against the Platform;
  • spread knowingly false information about ConsulTOpen;
  • create fake social media campaigns;
  • publish fabricated allegations;
  • manipulate public opinion through fraudulent conduct;
  • encourage coordinated harassment;
  • impersonate ConsulTOpen representatives;
  • misuse Platform branding; or
  • otherwise act in bad faith to damage the Platform's reputation.

Nothing contained herein prevents Users from making genuine complaints, providing honest feedback or exercising rights available under applicable law.

48. Cooperation During Investigations

Users shall reasonably cooperate with investigations conducted by ConsulTOpen relating to:

  • complaints;
  • fraud;
  • refund disputes;
  • payment disputes;
  • Platform misuse;
  • Policy violations;
  • identity verification;
  • Child Safety concerns;
  • security incidents;
  • legal compliance;
  • regulatory requirements; or
  • other matters reasonably requiring investigation.

Without limitation, Users may be requested to:

  • provide additional information;
  • submit supporting documents;
  • verify their identity;
  • clarify relevant events;
  • cooperate with Platform personnel;
  • preserve relevant evidence; and
  • respond honestly to reasonable enquiries.

Failure to cooperate may affect continued access to Platform services.

49. Reporting Concerns

Users are encouraged to promptly report conduct that may violate Platform Policies or applicable law.

Reportable concerns may include:

  • harassment;
  • discrimination;
  • fraud;
  • identity theft;
  • Child Safety concerns;
  • abusive behaviour;
  • Platform misuse;
  • payment fraud;
  • security vulnerabilities;
  • intellectual property infringement;
  • unlawful activity; or
  • any other conduct reasonably believed to violate Platform Policies.

Reports should be made honestly and in good faith.

Knowingly submitting false or malicious reports constitutes a violation of this Code.

ConsulTOpen shall review reports in accordance with its Grievance Redressal Policy and applicable law.

50. Compliance with Platform Policies

Users shall comply with every applicable Platform Policy while using ConsulTOpen.

Without limitation, Users shall comply with:

  • Terms & Conditions;
  • Privacy Policy;
  • Cookie & Data Retention Policy;
  • Session Standards Policy;
  • Refund Policy;
  • Community Guidelines;
  • AI Usage Disclaimer;
  • Recommendation Disclaimer;
  • Career Guidance Disclaimer;
  • Mental Wellness Disclaimer;
  • Intellectual Property Policy;
  • Child Safety Policy;
  • Parent Consent Policy;
  • Grievance Redressal Policy; and
  • every future Platform Policy published by ConsulTOpen.

Failure to comply with any applicable Platform Policy may result in enforcement action under this Code.

PART VII – ENFORCEMENT

51. Complaints

ConsulTOpen may receive complaints relating to User conduct from Consultants, Users, Platform personnel or other appropriate sources.

Complaints may relate to:

  • harassment;
  • abusive behaviour;
  • discrimination;
  • fraud;
  • payment misconduct;
  • identity misrepresentation;
  • Platform misuse;
  • academic misconduct;
  • Child Safety concerns;
  • privacy violations;
  • intellectual property infringement;
  • review manipulation; or
  • any other conduct inconsistent with this Code.

Submission of a complaint does not automatically establish that a violation has occurred.

52. Investigations

ConsulTOpen may investigate any suspected violation of this Code or other Platform Policies.

Investigations may include:

  • review of Platform records;
  • review of consultation logs;
  • review of payment records;
  • review of communications;
  • review of User reports;
  • identity verification;
  • consultation with relevant parties;
  • technical analysis;
  • legal review where appropriate; and
  • any other lawful investigative measure reasonably necessary.

Users shall cooperate honestly with every lawful investigation.

ConsulTOpen shall conduct investigations fairly, reasonably and in accordance with applicable law.

53. Corrective Action

Where ConsulTOpen reasonably determines that a User has violated this Code, appropriate corrective action may be taken.

Corrective action shall be proportionate to the seriousness, frequency and impact of the relevant conduct.

Without limitation, corrective action may include:

  • educational guidance;
  • verbal warnings;
  • written warnings;
  • mandatory policy acknowledgement;
  • temporary restrictions on Platform features;
  • cancellation of consultations;
  • removal of content;
  • suspension of specific services;
  • additional verification requirements;
  • monitoring of User activity;
  • financial adjustments where applicable;
  • temporary suspension;
  • permanent termination; or
  • any other lawful action reasonably considered necessary.

54. Suspension

ConsulTOpen reserves the unrestricted right to temporarily suspend a User Account where reasonably necessary.

Suspension may occur where there are reasonable grounds to believe that:

  • this Code has been materially violated;
  • Platform Policies have been violated;
  • fraudulent activity has occurred;
  • identity verification has failed;
  • User safety is at risk;
  • Child Safety requirements have been violated;
  • unlawful activity is reasonably suspected;
  • Platform security has been compromised;
  • payment fraud has occurred;
  • abusive behaviour has occurred; or
  • continued Platform access presents a material risk to Users or the Platform.

During suspension, ConsulTOpen may temporarily restrict access to some or all Platform features pending investigation.

55. Termination

ConsulTOpen may permanently terminate a User Account where continued participation on the Platform is no longer appropriate.

Termination may occur following:

  • repeated Policy violations;
  • serious misconduct;
  • fraud;
  • identity theft;
  • Child Safety violations;
  • unlawful activity;
  • repeated harassment;
  • repeated abuse of Platform services;
  • security threats;
  • repeated payment misconduct; or
  • any other serious breach of this Code.

Termination shall not affect any legal rights, obligations or liabilities that accrued prior to termination.

56. Appeals

Users whose Accounts have been suspended or terminated may submit an appeal through the authorised grievance or support channels where permitted by ConsulTOpen.

Appeals should:

  • identify the relevant decision;
  • explain the basis of the appeal;
  • provide supporting information where available; and
  • be submitted within any applicable time period communicated by ConsulTOpen.

Submission of an appeal does not automatically suspend or reverse the original decision.

ConsulTOpen shall review appeals fairly, reasonably and in accordance with applicable Platform Policies.

The outcome of an appeal shall be communicated within a reasonable period, subject to the complexity of the matter.

PART VIII – GENERAL PROVISIONS

57. Continuous Improvement

ConsulTOpen is committed to continuously improving the safety, professionalism and integrity of its Platform.

Accordingly, ConsulTOpen may periodically review and improve this Code based upon:

  • User feedback;
  • Consultant feedback;
  • operational experience;
  • technological developments;
  • Artificial Intelligence advancements;
  • industry best practices;
  • legal developments;
  • regulatory requirements;
  • security considerations;
  • quality assurance findings; and
  • other factors reasonably relevant to Platform operations.

58. Policy Amendments

ConsulTOpen reserves the unrestricted right to amend, revise, supplement, replace or update this User Code of Conduct at any time.

Without limitation, amendments may be made to reflect:

  • changes in applicable law;
  • judicial decisions;
  • regulatory requirements;
  • technological developments;
  • Platform improvements;
  • Artificial Intelligence developments;
  • cybersecurity requirements;
  • operational experience;
  • User feedback;
  • Consultant feedback;
  • business requirements; or
  • any other lawful operational necessity.

Material amendments may be communicated through:

  • Website notices;
  • Dashboard notifications;
  • Email;
  • SMS;
  • WhatsApp;
  • Push notifications;
  • In-app notifications; or
  • any other electronic communication channel considered appropriate by ConsulTOpen.

Continued use of the Platform following the effective date of an amendment shall constitute acceptance of the revised Code to the fullest extent permitted by applicable law.

59. Severability

If any provision of this User Code of Conduct is determined by a court, tribunal or competent authority to be invalid, unlawful or unenforceable, such provision shall be enforced to the maximum extent permitted by applicable law.

The remaining provisions shall remain valid, binding and enforceable.

Where reasonably possible, the invalid provision shall be interpreted or modified in a manner that most closely reflects its original legal and operational intent while remaining legally enforceable.

60. No Waiver

Failure or delay by ConsulTOpen to exercise or enforce any right, remedy or provision available under this Code shall not constitute:

  • waiver;
  • abandonment;
  • estoppel;
  • limitation of future enforcement; or
  • relinquishment of any legal or contractual right.

Any waiver shall be valid only if expressly made in writing by an authorised representative of ConsulTOpen.

61. Relationship with Other Policies

This User Code of Conduct forms an integral part of the legal and operational framework governing the ConsulTOpen Platform.

This Code shall be read together with:

  • Terms & Conditions;
  • Privacy Policy;
  • Cookie & Data Retention Policy;
  • Session Standards Policy;
  • Refund Policy;
  • Payout & Commission Policy;
  • Consultant Terms & Conditions;
  • Consultant Code of Conduct;
  • Consultant Onboarding Handbook;
  • AI Usage Disclaimer;
  • Recommendation Disclaimer;
  • Career Guidance Disclaimer;
  • Mental Wellness Disclaimer;
  • Intellectual Property Policy;
  • Community Guidelines;
  • Child Safety Policy;
  • Parent Consent Policy;
  • Grievance Redressal Policy; and
  • every future Platform Policy published by ConsulTOpen.

Where any inconsistency exists between this Code and another Platform Policy, the more specific provision governing User conduct shall prevail with respect to the relevant subject matter unless otherwise required by applicable law.

ConsulTOpen shall use commercially reasonable efforts to acknowledge and respond to communications relating to this Code within a reasonable period, subject to identity verification, applicable law and the complexity of the matter.

63. Effective Date

This User Code of Conduct shall become effective on the Effective Date specified in the Document Control section.

By accessing, registering for, subscribing to, booking consultations through or otherwise using the ConsulTOpen Platform, every User acknowledges that they have read, understood and agree to comply with this User Code of Conduct together with every other applicable Platform Policy.

Nothing contained in this Code shall limit any rights, obligations or remedies available under applicable law or under any other binding agreement between the User and ConsulTOpen.
