PART I – PRELIMINARY PROVISIONS

1. Introduction

Welcome to ConsulTOpen.

ConsulTOpen is committed to protecting the safety, privacy, wellbeing and best interests of every Minor User accessing or using the Platform.

This Parent Consent Policy ("Policy") establishes the framework governing the collection, verification, management, renewal and withdrawal of Parent or Legal Guardian consent for Minor Users using the ConsulTOpen Platform.

ConsulTOpen recognises that Parents and Legal Guardians play a vital role in supporting, supervising and protecting Minor Users while they access digital services, educational resources, career guidance and mental wellness services.

Accordingly, this Policy establishes the respective rights, responsibilities and obligations of:

  • Minor Users;
  • Parents;
  • Legal Guardians;
  • Educational Institutions;
  • Consultants;
  • ConsulTOpen; and
  • every other participant involved in services provided to Minor Users.

This Policy applies to every service involving a Minor User, including without limitation:

  • account creation;
  • account management;
  • consultation bookings;
  • career guidance services;
  • mental wellness services;
  • mentorship programmes;
  • Artificial Intelligence features;
  • subscriptions;
  • educational services;
  • messaging;
  • payments;
  • profile management;
  • future Platform features; and
  • every other service provided through the ConsulTOpen Platform.

ConsulTOpen shall require valid Parent or Legal Guardian consent before permitting a Minor User to access or use Platform services where such consent is required under this Policy or applicable law.

This Policy forms an integral part of the legal and operational framework governing the ConsulTOpen Platform.

2. Purpose

The purpose of this Policy is to establish a transparent, lawful and consistent framework governing Parent or Legal Guardian consent for Minor Users using the ConsulTOpen Platform.

Without limitation, this Policy governs:

  • Parent or Legal Guardian consent requirements;
  • eligibility to provide consent;
  • informed consent;
  • electronic consent;
  • OTP verification;
  • identity verification;
  • information required for consent;
  • Parent or Legal Guardian rights;
  • Parent or Legal Guardian responsibilities;
  • Educational Institution responsibilities;
  • Minor User participation;
  • Artificial Intelligence access by Minor Users;
  • privacy and confidentiality;
  • consent verification;
  • consent renewal;
  • withdrawal of consent;
  • record retention;
  • fraud prevention;
  • investigations;
  • safeguarding procedures; and
  • every other matter reasonably connected with Parent or Legal Guardian consent.

This Policy is intended to:

  • protect Minor Users;
  • promote responsible parental involvement;
  • establish transparent consent procedures;
  • support lawful processing of children's information;
  • promote informed decision-making;
  • strengthen child safeguarding;
  • encourage responsible digital participation;
  • protect Consultants;
  • support Educational Institutions;
  • maintain Platform integrity; and
  • ensure compliance with applicable laws.

3. Scope

This Policy applies to every Parent, Legal Guardian, Minor User, Educational Institution, Consultant and other participant involved in services provided to Minor Users through the ConsulTOpen Platform.

Without limitation, this Policy applies to:

  • Minor Users;
  • Parents;
  • Legal Guardians;
  • Consultants;
  • schools;
  • colleges;
  • universities;
  • coaching institutions;
  • Educational Institutions;
  • corporate organisations conducting programmes involving Minor Users;
  • Platform personnel;
  • authorised representatives;
  • contractors where applicable; and
  • every future participant involved in services relating to Minor Users.

This Policy applies irrespective of:

  • consultation category;
  • consultation format;
  • subscription plan;
  • communication method;
  • geographical location;
  • language;
  • operating system;
  • device used;
  • payment method;
  • Artificial Intelligence features; or
  • future Platform technologies introduced by ConsulTOpen.

This Policy applies before, during and after every interaction involving a Minor User where the relevant conduct relates to Parent or Legal Guardian consent.

PART II – PARENTAL CONSENT FRAMEWORK

4. Definitions

For the purposes of this Policy:

"Minor User" means any individual below eighteen (18) years of age unless otherwise required by applicable law.

"Parent" means a biological or adoptive parent having lawful responsibility for a Minor User.

"Legal Guardian" means any individual or entity lawfully authorised to exercise responsibility for a Minor User.

"Educational Institution" means any school, college, university, coaching institution or other educational organisation facilitating services involving Minor Users.

"Consultant" means an individual approved by ConsulTOpen to provide professional services through the Platform.

"Platform" means the ConsulTOpen website, mobile applications, software, Artificial Intelligence systems and every related service operated by ConsulTOpen.

"Consent" means the informed, voluntary and verifiable permission provided by a Parent or Legal Guardian permitting a Minor User to access or use Platform services.

"OTP Verification" means One-Time Password verification or any equivalent electronic verification mechanism adopted by ConsulTOpen.

"Artificial Intelligence" or "AI" means any automated technology, machine learning system or intelligent software feature made available through the Platform.

Unless otherwise defined herein, capitalised terms shall have the meanings assigned to them in the Terms & Conditions or other applicable Platform Policies.

5. Applicability

Compliance with this Policy is mandatory whenever a Minor User accesses or uses the ConsulTOpen Platform.

This Policy applies from the moment:

  • an account involving a Minor User is created;
  • Parent or Legal Guardian consent is requested;
  • a Minor User accesses the Platform;
  • consultations involving a Minor User are booked;
  • subscriptions involving a Minor User are purchased;
  • Artificial Intelligence features are accessed by a Minor User;
  • educational services involving a Minor User are requested; or
  • any other Platform service involving a Minor User is used.

Failure to comply with this Policy may result in:

  • refusal of access to Platform services;
  • suspension of Minor User accounts;
  • suspension of Parent or Legal Guardian accounts where applicable;
  • cancellation of consultations;
  • withdrawal of Platform access;
  • additional verification requirements;
  • termination of Platform services;
  • reporting to competent authorities where required by applicable law; or
  • any other lawful action reasonably considered necessary by ConsulTOpen.

6. Best Interests of the Child

The safety, wellbeing, dignity and best interests of every Minor User shall remain the primary consideration in every decision made under this Policy.

Parents, Legal Guardians, Consultants, Educational Institutions and ConsulTOpen shall endeavour to:

  • protect Minor Users;
  • support healthy development;
  • encourage responsible Platform usage;
  • promote safe digital participation;
  • respect the rights of Minor Users;
  • support informed decision-making;
  • comply with applicable safeguarding obligations;
  • encourage appropriate parental involvement;
  • minimise foreseeable risks; and
  • act in the best interests of the Minor User.

Where a conflict arises between commercial convenience and the safety or wellbeing of a Minor User, the interests of the Minor User shall take priority to the fullest extent permitted by applicable law.

7. Relationship with Other Policies

This Parent Consent Policy forms an integral part of the legal and operational framework governing the ConsulTOpen Platform.

This Policy shall be read together with:

  • Terms & Conditions;
  • Privacy Policy;
  • Cookie & Data Retention Policy;
  • Child Safety Policy;
  • User Code of Conduct;
  • Consultant Terms & Conditions;
  • Consultant Code of Conduct;
  • Consultant Onboarding Handbook;
  • Session Standards Policy;
  • Refund Policy;
  • Payout & Commission Policy;
  • AI Usage Disclaimer;
  • Recommendation Disclaimer;
  • Career Guidance Disclaimer;
  • Mental Wellness Disclaimer;
  • Intellectual Property Policy;
  • Community Guidelines;
  • Grievance Redressal Policy; and
  • every future Platform Policy published by ConsulTOpen.

Where any inconsistency exists between this Policy and another Platform Policy, the provision providing the greater protection to Minor Users shall prevail unless otherwise required by applicable law.

8. Acceptance

This Parent Consent Policy constitutes an electronic record governing Parent or Legal Guardian consent for Minor Users using the ConsulTOpen Platform.

A Parent, Legal Guardian or other authorised person shall be deemed to have accepted this Policy by:

  • creating an account for a Minor User;
  • providing Parent or Legal Guardian consent;
  • completing OTP verification;
  • booking consultations for a Minor User;
  • purchasing subscriptions for a Minor User;
  • permitting a Minor User to use Platform services;
  • continuing to use the Platform on behalf of a Minor User; or
  • otherwise authorising a Minor User to access Platform services.

Electronic consent and acceptance under this Policy shall have the same legal validity and enforceability as a handwritten signature to the fullest extent permitted by applicable law.

By accepting this Policy, every Parent, Legal Guardian and other authorised participant acknowledges that they have read, understood and agree to comply with the rights, responsibilities and obligations established herein together with every other applicable Platform Policy.

PART III – RIGHTS & RESPONSIBILITIES

16. Parent or Legal Guardian Rights

Subject to applicable law and Platform Policies, Parents or Legal Guardians shall have the right to:

  • create a Minor User account;
  • provide consent for Platform access;
  • book consultations for a Minor User;
  • purchase subscriptions;
  • manage bookings made on behalf of a Minor User;
  • access payment receipts and invoices;
  • communicate with ConsulTOpen through authorised channels;
  • participate in consultations where appropriate;
  • withdraw consent in accordance with this Policy;
  • request assistance regarding Platform usage;
  • request correction of inaccurate information;
  • request deletion of information where permitted by applicable law;
  • report child safety concerns;
  • receive information reasonably necessary to support the Minor User, subject to

applicable law and confidentiality obligations; and

  • exercise every other right available under applicable law and Platform Policies.

Nothing contained herein shall limit any statutory rights available to Parents or Legal Guardians.

17. Parent or Legal Guardian Responsibilities

Parents or Legal Guardians remain primarily responsible for supervising and supporting Minor Users while they access Platform services.

Without limitation, Parents or Legal Guardians shall:

  • provide accurate information;
  • complete consent procedures honestly;
  • complete OTP verification where required;
  • supervise younger Minor Users where appropriate;
  • ensure that the Minor User uses the Platform responsibly;
  • encourage respectful behaviour;
  • monitor account security;
  • maintain accurate contact information;
  • promptly report suspected misuse;
  • cooperate with safeguarding procedures;
  • comply with applicable laws;
  • comply with Platform Policies; and
  • act in the best interests of the Minor User.

Parents or Legal Guardians shall not knowingly permit a Minor User to misuse Platform services.

18. Shared Responsibility

The safety and wellbeing of Minor Users is a shared responsibility among:

  • Parents;
  • Legal Guardians;
  • Minor Users;
  • Consultants;
  • Educational Institutions;
  • ConsulTOpen; and
  • every other participant involved in Platform services.

Accordingly, every participant shall:

  • promote child safety;
  • encourage responsible online behaviour;
  • support respectful communication;
  • comply with safeguarding procedures;
  • report concerns in good faith;
  • cooperate during investigations;
  • respect confidentiality;
  • follow applicable Platform Policies; and
  • contribute to a safe and supportive environment for Minor Users.

Nothing contained herein transfers the primary safeguarding responsibilities imposed by applicable law upon Parents, Legal Guardians or other legally responsible persons.

19. Educational Institution Responsibilities

Educational Institutions facilitating Platform services involving Minor Users shall ensure that they possess every consent, approval and authorisation required under applicable law before facilitating such services.

Without limitation, Educational Institutions shall:

  • obtain necessary Parent or Legal Guardian permissions where required;
  • cooperate with verification procedures;
  • provide accurate information;
  • support child safeguarding measures;
  • encourage responsible Platform usage;
  • promptly report safeguarding concerns;
  • comply with applicable laws;
  • comply with Platform Policies; and
  • cooperate with ConsulTOpen where reasonably necessary.

ConsulTOpen may request reasonable evidence that the necessary permissions have been obtained before providing services involving Minor Users.

20. Minor User Responsibilities

Minor Users are expected to use the Platform responsibly and respectfully.

Without limitation, Minor Users shall:

  • provide truthful information where appropriate;
  • behave respectfully towards Consultants and other Users;
  • comply with Platform Policies;
  • avoid misuse of Platform services;
  • protect account credentials;
  • avoid sharing personal information unnecessarily;
  • report inappropriate conduct;
  • cooperate with safeguarding procedures;
  • communicate honestly; and
  • seek assistance from a Parent, Legal Guardian or trusted adult whenever appropriate.

Nothing contained herein reduces the safeguarding obligations owed by adults to Minor Users.

21. Consent for AI Features

Where Parent or Legal Guardian consent is required under this Policy, such consent shall also apply to the Minor User's access to Artificial Intelligence ("AI") features made available through the Platform.

Parents or Legal Guardians acknowledge that:

  • AI features are intended to assist Users;
  • AI-generated outputs may contain errors;
  • AI does not replace professional advice;
  • AI recommendations should be evaluated appropriately;
  • AI usage remains subject to the AI Usage Disclaimer; and
  • ConsulTOpen may introduce additional safeguards for AI features used by Minor

Users.

ConsulTOpen reserves the right to restrict or disable AI features for Minor Users where reasonably necessary to protect their safety or wellbeing.

22. Privacy & Confidentiality

ConsulTOpen recognises the importance of balancing parental involvement with the privacy, dignity and wellbeing of Minor Users.

Accordingly:

  • Parents or Legal Guardians shall receive information where appropriate, lawful or

reasonably necessary;

  • Consultants shall respect the confidentiality of Minor Users to the fullest extent

permitted by applicable law;

  • confidentiality may be limited where necessary to protect the Minor User or comply

with applicable law;

  • Platform Privacy Policies shall continue to apply; and
  • disclosures shall be limited to what is reasonably necessary for the relevant purpose.

Nothing contained herein shall prevent lawful disclosures required to protect a Minor User.

23. Best Interests of the Child During Platform Use

Every Parent, Legal Guardian, Consultant, Educational Institution and Platform participant shall act in a manner that promotes the best interests of the Minor User throughout their use of the Platform.

Accordingly, participants should:

  • prioritise child safety;
  • encourage healthy learning;
  • support emotional wellbeing;
  • encourage respectful interactions;
  • promote responsible technology use;
  • minimise foreseeable risks;
  • support appropriate adult supervision where necessary;
  • encourage open communication;
  • cooperate with safeguarding measures; and
  • comply with applicable child protection laws.

Where any decision affects a Minor User, the child's safety, dignity and wellbeing shall remain the primary consideration.

PART IV – CONSENT MANAGEMENT

24. Verification of Consent

ConsulTOpen reserves the right to verify Parent or Legal Guardian consent before permitting a Minor User to access or continue using Platform services.

Verification may include:

  • OTP verification;
  • confirmation of contact details;
  • identity verification;
  • verification of the relationship with the Minor User;
  • supporting documentation where reasonably necessary;
  • additional security verification;
  • communication with the Parent or Legal Guardian;
  • Educational Institution verification where applicable; and
  • any other lawful verification procedure reasonably adopted by ConsulTOpen.

Failure to complete verification may result in delayed, restricted or refused access to Platform services.

25. Reverification of Consent

ConsulTOpen may require Parent or Legal Guardian consent to be reverified whenever reasonably necessary.

Reverification may be requested where:

  • identity information changes;
  • contact details change;
  • safeguarding concerns arise;
  • fraudulent activity is reasonably suspected;
  • Platform services materially change;
  • applicable laws change;
  • additional verification becomes reasonably necessary;
  • significant account changes occur; or
  • any other circumstance reasonably requires renewed verification.

Failure to complete reverification may result in temporary suspension of Platform services until the process has been completed.

26. Consent Records

ConsulTOpen may maintain records relating to Parent or Legal Guardian consent for operational, legal and safeguarding purposes.

Without limitation, consent records may include:

  • Parent or Legal Guardian details;
  • OTP verification records;
  • consent confirmations;
  • identity verification records;
  • timestamps;
  • account information;
  • communication records relating to consent;
  • consent updates;
  • consent withdrawal requests; and
  • other information reasonably necessary to demonstrate lawful consent.

Consent records shall be maintained in accordance with applicable law and the Privacy Policy.

27. Record Retention

Consent records shall be retained only for as long as reasonably necessary to:

  • comply with applicable law;
  • satisfy regulatory requirements;
  • resolve disputes;
  • investigate safeguarding concerns;
  • support audits;
  • protect legal rights;
  • maintain business records;
  • enforce Platform Policies; or
  • fulfil other legitimate legal or operational purposes.

Following expiry of the applicable retention period, records may be securely deleted, anonymised or otherwise handled in accordance with applicable law and the Privacy Policy.

28. Withdrawal of Consent

A Parent or Legal Guardian may withdraw previously granted consent at any time by contacting ConsulTOpen through the authorised support channels.

Withdrawal of consent may affect the Minor User's ability to continue accessing Platform services.

Withdrawal shall not invalidate:

  • actions lawfully taken before withdrawal;
  • completed consultations;
  • lawful processing already undertaken;
  • records retained pursuant to legal obligations;
  • dispute resolution processes; or
  • any other lawful activity completed before the withdrawal became effective.

29. Effect of Withdrawal

Upon receiving a valid withdrawal of consent, ConsulTOpen may, where appropriate:

  • suspend the Minor User's account;
  • restrict access to Platform services;
  • cancel future consultations;
  • discontinue subscriptions at the end of the applicable billing period where appropriate;
  • disable access to AI features;
  • retain information required by law;
  • preserve records for safeguarding or dispute resolution purposes;
  • comply with applicable legal obligations; and
  • take any other lawful action reasonably necessary to implement the withdrawal.

ConsulTOpen shall endeavour to implement valid withdrawal requests within a reasonable period.

30. Policy Updates, Consent Renewal & Consent for New Services

ConsulTOpen may require renewed Parent or Legal Guardian consent where reasonably necessary.

Renewed consent may be requested where:

  • this Policy undergoes material changes;
  • Platform services materially expand;
  • new categories of services involving Minor Users are introduced;
  • new Artificial Intelligence features become available;
  • new educational programmes are launched;
  • applicable legal requirements change;
  • safeguarding standards evolve;
  • regulatory requirements change; or
  • any other circumstance reasonably requires fresh informed consent.

Where renewed consent is required and is not provided, ConsulTOpen may limit or suspend access to the relevant new services until valid consent has been obtained.

PART V – SAFETY & COMPLIANCE

31. Child Protection Measures

ConsulTOpen is committed to maintaining a safe, secure and supportive environment for every Minor User.

Accordingly, ConsulTOpen may implement reasonable child protection measures, including:

  • Parent or Legal Guardian consent verification;
  • identity verification;
  • age verification;
  • safeguarding procedures;
  • Platform monitoring;
  • Consultant eligibility requirements;
  • child safeguarding training for Consultants where applicable;
  • reporting mechanisms;
  • emergency response procedures;
  • Artificial Intelligence safety measures;
  • privacy safeguards;
  • access controls; and
  • every other lawful safeguarding measure reasonably necessary to protect Minor

Users.

Every User, Parent, Legal Guardian, Consultant and Educational Institution shall cooperate with reasonable child protection measures implemented by ConsulTOpen.

32. Emergency Situations

ConsulTOpen is not an emergency response service.

Where ConsulTOpen or a Consultant reasonably believes that a Minor User may be facing:

  • immediate danger;
  • abuse;
  • neglect;
  • exploitation;
  • suicidal thoughts;
  • self-harm;
  • serious violence;
  • medical emergencies;
  • trafficking; or
  • any other circumstance presenting an immediate risk to the Minor User,

ConsulTOpen or the Consultant may take appropriate safeguarding action, including:

  • contacting the Parent or Legal Guardian where appropriate;
  • contacting emergency services;
  • contacting child protection authorities;
  • contacting law enforcement authorities where required;
  • temporarily restricting Platform access;
  • initiating internal safeguarding procedures; or
  • taking any other lawful action reasonably necessary to protect the Minor User.

Nothing contained herein prevents immediate action where delay may increase the risk of harm to a Minor User.

33. Fraud Prevention

ConsulTOpen reserves the right to implement reasonable measures to prevent fraudulent or unauthorised Parent or Legal Guardian consent.

Without limitation, ConsulTOpen may:

  • verify OTP confirmations;
  • verify identity information;
  • request supporting documentation;
  • verify relationships with Minor Users;
  • perform additional security checks;
  • investigate suspicious activity;
  • review account activity;
  • conduct fraud assessments;
  • suspend suspicious accounts pending verification; and
  • implement any other lawful fraud prevention measures reasonably necessary.

Fraud prevention measures are intended to protect Minor Users, Parents, Legal Guardians, Consultants and the integrity of the Platform.

34. False Consent

No person shall knowingly provide false, misleading or fraudulent Parent or Legal Guardian consent.

Without limitation, prohibited conduct includes:

  • impersonating a Parent;
  • impersonating a Legal Guardian;
  • providing false relationship information;
  • submitting forged documents;
  • using another person's contact details;
  • fraudulently completing OTP verification;
  • providing inaccurate identity information;
  • obtaining consent through deception;
  • facilitating fraudulent consent; or
  • otherwise attempting to circumvent this Policy.

Providing false consent may result in:

  • refusal of Platform access;
  • suspension of accounts;
  • termination of Platform services;
  • cancellation of consultations;
  • reporting to competent authorities where required by applicable law; and
  • any other lawful action reasonably considered necessary by ConsulTOpen.

35. Identity Misrepresentation

Users, Parents, Legal Guardians and every other participant shall provide accurate identity information while using the Platform.

No person shall:

  • create fake accounts;
  • impersonate another individual;
  • falsely claim parental authority;
  • falsely claim guardianship;
  • falsify a Minor User's age;
  • submit forged identity documents;
  • conceal material identity information;
  • share accounts in violation of Platform Policies; or
  • otherwise misrepresent identity while using the Platform.

Identity misrepresentation may result in immediate suspension or termination of Platform access.

36. Cooperation During Investigations

Parents, Legal Guardians, Minor Users, Educational Institutions, Consultants and every other relevant participant shall reasonably cooperate with investigations relating to:

  • safeguarding concerns;
  • consent verification;
  • fraud;
  • identity verification;
  • Child Safety concerns;
  • Policy violations;
  • legal compliance;
  • regulatory requirements;
  • complaints; or
  • any other matter reasonably requiring investigation.

Cooperation may include:

  • providing additional information;
  • responding to reasonable enquiries;
  • submitting supporting documentation;
  • verifying identity;
  • clarifying relevant events;
  • preserving relevant information; and
  • assisting lawful investigations.

Failure to cooperate may result in delayed services, temporary restrictions or other lawful action reasonably necessary to protect Minor Users and the Platform.

37. Cooperation with Authorities

Where authorised or required by applicable law, ConsulTOpen may cooperate with:

  • law enforcement agencies;
  • child protection authorities;
  • judicial authorities;
  • regulatory authorities;
  • educational institutions where appropriate;
  • governmental agencies;
  • emergency responders; and
  • every other competent authority.

Such cooperation may occur where reasonably necessary to:

  • protect a Minor User;
  • investigate safeguarding concerns;
  • verify lawful consent;
  • prevent unlawful conduct;
  • comply with legal obligations;
  • respond to lawful requests;
  • protect Platform integrity; or
  • safeguard public safety.

Nothing contained herein requires ConsulTOpen to disclose information except where disclosure is authorised or required by applicable law.

PART VI – ENFORCEMENT

38. Investigations

ConsulTOpen may investigate any suspected violation of this Parent Consent Policy.

Investigations may include:

  • review of consent records;
  • review of account information;
  • OTP verification records;
  • communication records;
  • identity verification records;
  • safeguarding assessments;
  • consultation with relevant parties;
  • technical analysis;
  • legal review; and
  • any other lawful investigative measure reasonably necessary.

Investigations shall be conducted fairly, confidentially and in accordance with applicable law.

39. Corrective Action

Where ConsulTOpen reasonably determines that this Policy has been violated, appropriate corrective action may be taken.

Corrective action shall be proportionate to:

  • the seriousness of the conduct;
  • the level of risk posed to the Minor User;
  • previous conduct;
  • cooperation during the investigation;
  • applicable legal obligations; and
  • every other relevant circumstance.

Corrective action may include:

  • educational guidance;
  • verbal warnings;
  • written warnings;
  • additional verification requirements;
  • temporary service restrictions;
  • cancellation of consultations;
  • removal of access to specific services;
  • suspension;
  • permanent termination; or
  • any other lawful action reasonably necessary.

40. Suspension

ConsulTOpen reserves the right to temporarily suspend Platform access where reasonably necessary to:

  • protect Minor Users;
  • investigate safeguarding concerns;
  • verify Parent or Legal Guardian consent;
  • investigate suspected fraud;
  • investigate identity misrepresentation;
  • comply with applicable law;
  • comply with regulatory requirements;
  • preserve Platform integrity; or
  • protect other Users.

During suspension, access to some or all Platform features may be restricted until the relevant concerns have been resolved.

41. Termination

ConsulTOpen may permanently terminate access to Platform services where continued participation is inconsistent with this Policy or the safety of Minor Users.

Termination may occur following:

  • fraudulent consent;
  • repeated Policy violations;
  • identity fraud;
  • safeguarding violations;
  • unlawful activity;
  • serious misconduct;
  • repeated failure to comply with consent requirements; or
  • any other conduct reasonably considered incompatible with the safe operation of the

Platform.

Termination shall not affect any legal rights, obligations or liabilities accrued prior to termination.

42. Appeals

Where permitted by ConsulTOpen, Parents, Legal Guardians or other affected participants whose accounts or services have been suspended or terminated under this Policy may submit an appeal through the authorised grievance or support channels.

Appeals should:

  • identify the relevant decision;
  • explain the grounds for appeal;
  • provide supporting information where available; and
  • be submitted within any applicable time period communicated by ConsulTOpen.

Submission of an appeal does not automatically suspend or reverse the original decision.

ConsulTOpen shall review appeals fairly, reasonably and in accordance with applicable law while ensuring that the safety and best interests of Minor Users remain the primary consideration.

PART VII – GENERAL PROVISIONS

43. Continuous Improvement

ConsulTOpen is committed to continuously strengthening its Parent or Legal Guardian consent framework to ensure the safety, privacy and wellbeing of Minor Users.

Accordingly, ConsulTOpen may periodically review and improve this Policy based upon:

  • developments in child protection practices;
  • changes in applicable laws;
  • judicial decisions;
  • regulatory guidance;
  • technological advancements;
  • developments in Artificial Intelligence;
  • cybersecurity requirements;
  • safeguarding best practices;
  • feedback from Parents or Legal Guardians;
  • feedback from Consultants;
  • feedback from Educational Institutions;
  • operational experience;
  • audit findings;
  • risk assessments; and
  • every other factor reasonably relevant to the protection of Minor Users.

ConsulTOpen reserves the right to introduce additional consent procedures, verification mechanisms or safeguarding measures whenever reasonably necessary to enhance the protection of Minor Users.

44. Policy Amendments

ConsulTOpen reserves the unrestricted right to amend, revise, supplement, replace or update this Parent Consent Policy whenever reasonably necessary.

Without limitation, amendments may be made to reflect:

  • changes in applicable laws;
  • child protection legislation;
  • privacy laws;
  • judicial decisions;
  • regulatory requirements;
  • technological developments;
  • Artificial Intelligence advancements;
  • cybersecurity requirements;
  • operational improvements;
  • safeguarding best practices;
  • educational partnerships;
  • Platform enhancements;
  • business requirements; or
  • any other lawful operational necessity.

Material amendments may be communicated through:

  • Website notices;
  • Dashboard notifications;
  • Email;
  • SMS;
  • WhatsApp;
  • Push notifications;
  • In-app notifications; or
  • any other electronic communication channel considered appropriate by ConsulTOpen.

Where reasonably necessary, ConsulTOpen may require renewed Parent or Legal Guardian consent before permitting continued access to certain Platform services.

Continued use of the Platform following the effective date of an amendment shall constitute acceptance of the revised Policy to the fullest extent permitted by applicable law.

45. Severability

If any provision of this Parent Consent Policy is determined by a court, tribunal or competent authority to be invalid, unlawful or unenforceable, such provision shall be enforced to the maximum extent permitted by applicable law.

The remaining provisions shall remain valid, binding and enforceable.

Where reasonably possible, any invalid provision shall be interpreted or modified in a manner that most closely reflects its original legal intent while remaining legally enforceable.

46. No Waiver

Failure or delay by ConsulTOpen to exercise or enforce any right, remedy or provision available under this Policy shall not constitute:

  • a waiver;
  • abandonment;
  • estoppel;
  • limitation of future enforcement; or
  • relinquishment of any legal or contractual right.

Any waiver shall be valid only if expressly made in writing by an authorised representative of ConsulTOpen.

No waiver of any breach shall constitute a waiver of any subsequent or continuing breach.

47. Relationship with Other Policies

This Parent Consent Policy forms an integral part of the legal and operational framework governing the ConsulTOpen Platform.

This Policy shall be read together with:

  • Terms & Conditions;
  • Privacy Policy;
  • Cookie & Data Retention Policy;
  • Child Safety Policy;
  • User Code of Conduct;
  • Consultant Terms & Conditions;
  • Consultant Code of Conduct;
  • Consultant Onboarding Handbook;
  • Session Standards Policy;
  • Refund Policy;
  • Payout & Commission Policy;
  • AI Usage Disclaimer;
  • Recommendation Disclaimer;
  • Career Guidance Disclaimer;
  • Mental Wellness Disclaimer;
  • Intellectual Property Policy;
  • Community Guidelines;
  • Grievance Redressal Policy; and
  • every future Platform Policy published by ConsulTOpen.

Where any inconsistency exists between this Policy and another Platform Policy, the provision providing the greater protection to the Minor User shall prevail unless otherwise required by applicable law.

ConsulTOpen shall use commercially reasonable efforts to acknowledge and respond to communications relating to this Policy within a reasonable period, subject to identity verification, applicable law and the complexity of the matter.

49. Effective Date

This Parent Consent Policy shall become effective on the Effective Date specified in the Document Control section.

By providing consent, completing OTP verification, creating or managing a Minor User account, booking consultations, purchasing subscriptions, permitting a Minor User to access Platform services or otherwise participating in services involving a Minor User, every Parent, Legal Guardian, Educational Institution and other authorised participant acknowledges and agrees that:

  • they have read and understood this Policy;
  • they are legally authorised to provide consent where applicable;
  • the information provided by them is true, complete and accurate;
  • they agree to comply with this Policy and every other applicable Platform Policy;
  • they understand the rights and responsibilities established under this Policy;
  • they acknowledge that ConsulTOpen may verify consent where reasonably necessary;
  • they understand that consent may be withdrawn in accordance with this Policy;
  • they acknowledge that child safety remains the highest priority of ConsulTOpen; and
  • they agree to cooperate with lawful safeguarding, verification and compliance

procedures.

Nothing contained in this Policy shall limit any rights, obligations or remedies available under applicable law or under any other binding agreement between the relevant participant and ConsulTOpen.
